Purchases on our site are subject to the provisions of Legislative Decree no. 185 of 05/22/1999, dictated on the subject of distance contracts, in cases where the delivery of the goods takes place at the buyer's domicile as said purchases are made outside the commercial premises. The importance of the aforementioned legislation is embodied in the provision that the buyer has the right of withdrawal.
To whom it applies
Community legislation provides that the right of withdrawal can only be exercised by natural persons (consumers) acting for purposes that can be considered unrelated to their commercial activity. The right of withdrawal, therefore, cannot be exercised by legal entities and natural persons acting for purposes related to a commercial activity. Purchases made by resellers or by individuals who in any capacity purchase for resale to third parties are also excluded from the right of withdrawal. Furthermore, based on art. 59 of the Legislative Decree. 205/2006 letter c) The right of withdrawal for distance contracts and contracts negotiated away from commercial premises is excluded in relation to the supply of goods made to measure or clearly personalized and non-standard.
What is it about
The consumer has the right to withdraw from the contract within 8 working days of receiving the goods, returning the goods subject to the withdrawal to the seller. The seller will refund the value of the returned goods with a never-expiring shopping voucher or, upon prior agreement, by bank transfer.
It should be noted that in the case of prize operations (the so-called promotions), in which the purchase of a good is combined with another good that is sold at a negligible price or even given as a gift, the right of withdrawal will be legitimately exercised with the return of both goods being purchased, given the constraint of the accessory nature of the promoted good compared to the first.
How to practice
It is necessary to request prior authorization from Mulligan.it Customer Service by completing a request in the Contact Form. From here it will be possible to send the request directly, with all the necessary information: order number, invoice number, the item code of the products that must be subject to withdrawal.
Within 2 working days, Mulligan.it Customer Service will open the withdrawal procedure, simultaneously issuing the authorization for the return of the components.
How to ship to Mulligan.it (return shipping)
After receiving the return authorization, it is necessary to insert the original packaging containing the goods into special packaging, in order to protect the original packaging of the products from any damage, writing or alteration. Mulligan.it reserves the right to refuse the goods received in the event of failure to comply with the above procedure.
The goods must be shipped at your own expense, to the departure warehouse, to the address indicated by Mulligan.it Customer Service.
We recommend insuring the shipment: if the item arrives damaged at the warehouse, Mulligan.it reserves the right to accept the goods.
For shipment it would be advisable to use an express courier or other suitable means to allow traceability of the shipment.
Mulligan.it will not refund the goods subject to the withdrawal if it does not receive the relevant delivery.
How long does the return transfer take?
Mulligan.it reserves the right to credit the customer with a shopping voucher without expiration, equal to the value of the returned goods.
This voucher can be used to make any purchase on the website www.Mulligan.it, without time limits.
Alternatively, upon agreement with the customer, Mulligan.it will credit the amount corresponding to the value of the goods resulting from the invoice, within 10 working days of receipt of the same.
Shipping costs will not be included in the aforementioned amount, in compliance with the art. 5, paragraph 6, Legislative Decree no. 185 of 05/22/1999.
Warnings
Mulligan.it reserves the right now not to accept shipments of components or products that do not contain original packaging, accessories and manuals, or shipments made without having activated the authorization request to Mulligan.it Customer Service.
Item replacement due to incorrect shipment
The product replacement procedure due to incorrect shipment can be activated when a product different from the one the customer ordered and, therefore, not present in his order has been mistakenly shipped by Mulligan.it. The procedure can be activated within 8 calendar days from the date of delivery of the goods.
The activation of the service can be carried out by contacting our Customer Service .
Before activating this service it is advisable to compare what has arrived with the technical description of the item on the Mulligan.it website, where it is possible to view a detailed photo of each item and its main technical characteristics.
Shipping costs are borne by Mulligan.it and the shipment must be made via courier.
The item must be returned in the condition in which it was delivered, therefore without signs or writings of any kind on the packaging and without it having been opened or used in any way. Mulligan.it recommends using a rigid box and special packaging that protects the item from damage during transport. The opening of the package will be allowed, as indispensable, only in the case in which the packaging does not allow the verification of the ordered product compared to the one delivered.
In the event that the item present in the purchase invoice is no longer available, you will be contacted by Customer Service , who will issue a Credit Note and make a simultaneous bank transfer to your current account. The amount of any credit note and bank transfer will be calculated taking into consideration any discounts and promotions present in the purchase invoice.
Item incomplete with some parts or accompanying material
This service can be activated within 8 days of receipt of the goods and if the same is not complete with all its accompanying parts or accessories.
Before activating this service, Mulligan.it recommends comparing what has been delivered with the technical description of the item, as well as the accompanying material described on the site.
The activation of the service can be carried out by contacting Customer Service.
Damage to the goods during home transport
In the event that the courier delivers with visibly damaged packaging, Mulligan.it recommends accepting the goods by placing the reason " Goods with visibly damaged packaging " on the transport document.
The Customer must therefore contact Customer Service , no later than 8 days, who will open a damage claim for the replacement of the goods. The same procedure must be activated with the methods indicated above also in the event of damage to the product.
In the event that the customer contacts Customer Service after the eighth day, Mulligan.it will have the right to decide to open a damage case that requires the replacement of the goods.
